Increasing Regulatory Fairness Act of 2015

(Sec. 2) This bill amends part C (Medicare+Choice) of title XVIII (Medicare) of the Social Security Act to direct the Department of Health and Human Services, by regulation and in accordance with certain notice and public comment requirements, to determine and announce annually for 2017 and each subsequent year:

  • the annual MedicareAdvantage (MA) capitation rate for each MA payment area for the year concerned,
  • the risk and other factors to be used in adjusting such rates for monthly payments in such year,
  • the MA region-specific non-drug monthly benchmark amount for each MA region and each MA regional plan for which a bid was submitted, and
  • the major policy changes to the risk adjustment model and the 5-star rating system that are determined to have an economic impact.
