- Amendment in the nature of a substitute sought to replace section 141's grant of immunity for employees of the United States conducting a search of a person with an exclusive remedy against the government for the actions of customs agents who act within the scope of their authority; and delete section 144 on border search authority for outbound mail.
- Purpose
- An amendment in the nature of a substitute numbered 2 printed in House Report 107-482 to amend section 141 by stating that Customs inspectors are not liable for civil damages for suits brought in connection with a personal search; by stating the U.S. Government consents to be sued, and be held liable for civil damages for suits brought in connection with a wrongful personal search; and to delete section 144 on Border Search Authority for Outbound Mail.
