- Providing that the United States Government is entitled to a larger percentage of the total award (generally presumed to be 5 percent), and that the ex gratia payment provided to certain claimants, who where otherwise excluded from sharing in the claims settlement under generally-accepted principles of international law and United States practice, is justified only by the extraordinary circumstances of the case and does not establish any precedent for future claims, negotiations or payments.
