Amendment in the nature of a substitute sought to allow the prohibited transaction rules under section 4975 of the Internal Revenue Code, and sections 406 and 408 of the Employee Retirement Security Act (ERISA) to be waived if certain requirements concerning disclosure, the provision for alternative independent advice, qualifications of individuals providing advice, and remedies are made available to plan participants.
