An amendment to the Panetta amendment. The amendment strikes the text of the Panetta amendment and adds provisions for civil action. The amendment provides that an employee may bring an action in an appropriate U.S. District Court against his employer or applicator to prevent and restrain use of registered pesticides by them if the pesticide is misbranded, the applicator uses methods inconsistent with the labeling, or the use of the pesticide will cause physical injury to the employee. The amendment provides a definition of "employee".
