Amendment97th Congress
An amendment to provide the Secretary of Agriculture with the authority to take measures he deems necessary to eradicate the infestation of a pest that is a threat to plant life and plant products and thus a burden to interstate or foreign commerce. The pest must be new to the U.S. or not previously known to be widely prevalent throughout the U.S. Such actions must be consistent with the Federal Insecticide, Fungicide, and Rodenticide Act and the Secretary must find that state programs are inadequate to meet the danger. The Secretary is to pay damages due to this program, and his determination of compensation is final. The program is to be carried out at U.S. expense.
