Amendment98th Congress
An amendment earlier today setting liability for certain damages. The amendment permits individuals who have been exposed to hazardous substances from facilities where disposal has occured to bring action for damages against those who 1) owned or operated the facility at the time of the disposal, 2) generated the hazardous substance in question, 3) transported the substance to the facility in question. The amendment sets out what those who bring the suit must prove. It also sets out exceptions to this liability: 1) act of God, 2) act of war, 3) certain third parties. The exposure must have occured within five years prior to enactment of this bill.
