Amendment98th Congress
An amendment dealing with emergency relief and health surveillance. The amendment provides that any individual or group may submit a petition to EPA providing evidence which 1) demonstrates that they are being exposed to any hazardous substance and 2) provides an empirical analysis of the level of exposure. The Administrator must take action if he determines that there is a "reasonable likelihood" that the substance is from a facility is or was treated, stored, recycled, or disposed of on a regular basis or at which removal action is being taken. The amendment specifies what type of action must be taken by the EPA. The amendment also requires the Administrator to establish action levels for hazardous substances based upon toxicological and epidemiological evaluations, among other factors.
