Amendment98th Congress
An amendment to provide that defendants will be held responsible for portions of the costs of response if they establish by the preponderance of the evidence that any portion of the costs of response is not the responsibility of that defendant. The amendment replaces language that says if a defendant shows the harm is divisible he shall be liable only for his portion.
