An amendment to exclude from the definition of 'hazardous constituent' those hazardous constituents which the owner or operator demonstrates to the satisfaction of the Administrator and the Administrator determines at the time of permitting will not migrate into ground or surface water in concentrations which may adversely affect human health or the environment.
