An amendment to the sections dealing with loan deferrals, adding the applicant for such deferrals must establish their eligibility to the satisfaction of the Secretary. The Secretary may review the ability to repay the loan from time to time and if the Secretary determines payments can be resumed, deferral is cancelled. The Secretary's determination is final unless it is found by a court to be arbitrary, capricious, or contrary to law.
