Amendment99th Congress
An amendment setting out the requirements for a state law to qualify as a garnishment law. The requirements include 1) up to 10 percent of disposable pay may be deducted, 2) gives an individual a minimum of 30 days written notice of such deductions, 3) gives individuals rights to inspect documents, 4) provides an appeal process, 5) prohibits employers from dismissing employees because of the deduction. It also increases from 30 percent to 35 percent the amount of a defaulted Guaranteed Student Loan that a State guaranty agency may keep to cover collection costs in those states that enact these garnishment laws.
