Amendment100th Congress
An amendment to allow employers to use polygraph tests in cases involving employee theft, embezzlement, misappropriation of funds, industrial espionage, and to investigate crimes which threaten public safety or which have resulted in substantial property damage. In such cases, polygraph tests may only be administered after notification of law enforcement officials or the employer's insurance company. Further, the amendment provides that all polygraph tests must be conducted in accordance with applicable state and local law, and in accordance with collective bargaining agreements.
