- Amendments extended "Buy America" provisions to programs administered by the Federal Aviation Administration; prohibited the fraudulent use of "Made in America" labels; and placed restrictions on the awarding of contracts to persons or enterprises domiciled or operating under the laws of a foreign government.
- Purpose
- An amendment comprised of three amendments offered en bloc to establish "Buy-American" requirements by providing that U.S.-made steel and manufactured products be used in all federally-financed aviation projects unless the inclusion of such domestic materials will increase the overall cost of the project by more than 25%. With particular regard to the procurement of facilities and equipment, U.S.-made steel and manufactured products also would not have to be used if the cost of U.S.-made components is more than 60% of the costs of all components of the facility or equipment, or if final assembly of the facility or equipment is done in the United States. The amendment would require the Transportation Department to declare any person who makes fraudulent use of a "Made-in-America" label ineligible to receive federal contracts or grants in conjunction with the projects authorized by the bill for a period of 3-5 years and prohibit the award of contracts or subcontracts for these projects to firms based in, or incorporated under the laws of, any country that maintains a "significant and persistant pattern or practice of discrimination" against U.S. products or services in its government procurement, where this discrimination results in identifiable harm to U.S. businesses.
