Purpose
An amendment to exempt commuter rail services from the bill's requirement that all new rail cars purchased or leased must be readily accessible to and useable by persons with disabilities, including persons who use wheelchairs. To be eligible for the amendment's exemption, a commuter rail service must meet the bill's requirement that within five years of the bill's enactment at least one car per train be accessible to those with disabilities. The amendment also provides that to be exempt, an operator must provide clear notice in stations as to which cars in its trains are accessible and where they are located, make a reasonable effort to provide persons with disabilities on accessible cars with the same services provided passengers on non-accessible cars, and add accessible cars to trains if the continued demand for accessible service cannot be met by just one accessible car per train.
