An amendment offered en bloc to modify the death penalty procedures imposed by the Gekas amendment. Specifically, the Gekas provisions affected relate to appointment of counsel for indigents eligible for the death sentence by maintaining the current law requirement that the Federal Government appoint counsel in all capital cases in federal habeas proceedings. The Brooks amendment also restores current law with regard to compensation of experts in federal trials. In addition, the Brooks amendment modifies the circumstances under which counsel is to be appointed, specifically pretrial proceedings as well as for the trial itself.
