An amendment to specify that the Lumbee Indians (and other Indians residing in Robeson County and adjacent North Carolina counties) are eligible to petition for federal recognition through the Interior Department's administrative recognition process. The amendment would establish a deadline for the Interior Department to complete its review of the Lumbee petition, and would prohibit the department from considering the size of the Lumbee population in making a decision for or against recognition. If the department fails to meet the deadline for action on the Lumbee petition, or decides against recognition, the amendment would allow the Lumbees to seek judicial review of the matter without first pursuing administrative appeals. Finally, the amendment would express the sense of Congress that requirements for prompt action on the Lumbee petition are not to delay review of other petitions for tribal recognition.
