An amendment to further clarify that the provisions of the bill do not cover non-union workplaces. The Peterson amendment is essentially identical to the legislation except for the further clarifications. The amendment makes clear that the bill's provisions would apply in cases where a labor organization has been certified by the NLRB or has otherwise been recognized by the employer as the exclusive bargaining representative for striking employees. The amendment provides that in cases of "recognitional strikes", the bill applies only if the employees' petition for an election for recognition was filed with the NLRB at least 30 days prior to the strike; if the petition was supported by a majority of employees in the bargaining unit; and if the NLRB has not completed action on the representation proceeding.

- Purpose
- Amendment in the nature of a substitute is identical to the bill, which prohibits employers from hiring permanent replacements for workers who engage in economic strikes, except that it clarified that the bill does not cover non-union workplaces. It restricts coverage only to strikes involving a union that is certified by the National Labor Relations Board (NLRB), recognized specifically by the employer, supported by 50% plus one of the workforce, and that waited 30 days after filing for a representational election by the NLRB before striking.
