- Amendment provides for the consideration of aggravating factors by a jury or court when it is considering imposing the death penalty for persons convicted as a drug kingpin.
- Purpose
- An amendment to provide procedures for imposing the death penalty for drug kingpins, even when in the commission of a crime, no death results. Under the amendment, the court could consider the following as aggravating factors when considering the imposition of the death penalty: Previous conviction of an offense for which a sentence of death or life imprisonment was authorized; a previous conviction of two or more serious offenses; a previous serious drug felony conviction; using a firearm in the commission of the offense; distribution of drugs to persons under the age of twenty-one; distribution near schools; importing, manufacturing or distributing a controlled substance mixed with a lethal adulterant.
