Amendment in the nature of a substitute sought to: (1) provide for mandatory coverage for Members of Congress; (2) require greater evidence of wrong-doing before an investigation can be initiated; (3) make funding for any investigation longer than 2 years subject to the Congressional appropriations process; (4) require independent counsels to seek reappointment after 2 years; (5) require the Federal government to reimburse legal fees for any person subject to an independent counsel investigation who is not indicted or is not convicted, or whose conviction is overturned on appeal; (6) grant subpoena power to the Attorney General for preliminary investigations; (7) require independent counsels to comply with Federal procedures concerning classified material; and (8) require the GSA to provide administrative support to independent counsels.

- Purpose
- An amendment in the nature of a substitute which would, like the bill, reauthorize the independent counsel law for five years, but would differ from the bill in significant ways, including: 1. Provide mandatory coverage for Members of Congress; 2. Require greater evidence of wrong-doing before an investigation can be initiated; 3. Make funding for any independent counsel investigation lasting longer than two years; 4. Require each independent counsel to apply to the special court division for reappointment every two years; 4. Give the special court division power to terminate an investigation at any time; 5. Require the Federal Government to reimburse legal fees for any person subject to an independent counsel investigation who is not indicted or is not convicted, or whose conviction is overturned on appeal; 6. Stipulate that expiration of the law would automatically terminate any existing investigation within 120 days.
